Hold Harmless

Transport Company and or the Heavy Load driver that secures the services of a specific Northwest Pilot Car Cooperative pilot, agrees to indemnify and hold harmless all other Northwest Pilot Car Cooperative pilots from any and all claims, judgments, costs, expenses and losses (including attorneys' fees) by reason of any claim of damage or injury to person (including death) or property, including but not limited to damage or injury sustained by the Transport Company, its employees, operators, contractors or customers, caused in whole or in part by the negligence, breach of contract, breach of warranty, or other fault or default on the part of the hired pilot or its employees or agents in the performance of, or pursuant to, its work for the Transport Company or its driver. Pilot members of this cooperative are not legally bound to each other.
